We do not offer consumer-purpose mortgage loans, owner-occupied residential mortgage loans, or conventional home loans for personal, family, or household use.

Nothing on this Website constitutes:- a commitment to lend;- an offer to extend credit on any specific terms;- a guarantee of approval, rate, loan amount, leverage, or closing; or- legal, tax, accounting, or investment advice.
All loan products, terms, and approvals are subject to change without notice and depend on borrower qualifications, property qualifications, loan purpose, documentation, underwriting review, lender or capital-provider guidelines, and applicable law.

Nothing on this Website is intended to solicit or offer any product or service in any jurisdiction where such activity would be unlawful or where we are not properly authorized.

16. Governing Law and Venue
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms, the Website, or the services described on the Website shall be brought exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction and venue of those courts.

17. Waiver and Severability
No waiver by Uncapco Financial, LLC of any term or condition in these Terms shall be deemed a further or continuing waiver of that term or condition or a waiver of any other term or condition.

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

18. Referral Partner Program

Uncapco Financial, LLC may, from time to time, offer a Referral Partner Program (“Program”) allowing users to receive a fee for successfully introducing prospective investors to Uncapco. By participating in the Program, you agree to the following:

18.1 Professional Certification & Licensing Compliance

Except where you are properly licensed and authorized by applicable law to perform mortgage-related activities in the relevant jurisdiction, you certify that your role is limited strictly to providing a lead introduction only. Unless so licensed, you represent and warrant that you:

- Have not negotiated, and will not negotiate, mortgage rates or terms with the prospect;

- Have not taken, and will not take, a loan application from the prospect;

- Have not provided, and will not provide, a quote or specific financing advice to the prospect; and

- Are not acting as a mortgage loan originator or broker in connection with the introduction.

18.2 Business-Purpose & Non-Owner Occupied Restriction

In compliance with applicable federal and state laws, including but not limited to the Real Estate Settlement Procedures Act (RESPA), referral fees are strictly limited to business-purpose, non-owner-occupied investment property loans. * No referral fees will be paid for any "consumer-purpose" loan, including but not limited to loans for primary residences, second homes, or any property intended for personal, family, or household use.

- Any attempt to solicit a referral fee for a consumer-purpose loan is a violation of these Terms and will result in immediate disqualification from the Program.

18.3 Referral Fee & Commission Split Eligibility

A referral fee or commission split may be paid for a successful introduction or broker-to-broker arrangement, provided that:

- The prospect successfully completes a business-purpose loan that closes and funds through Uncapco;

- The arrangement complies with all applicable state and federal laws regarding fee-sharing and licensing; and

- The loan is not cancelled, rescinded, or found to be fraudulent.

18.4 Non-Guarantee of Payout

Submission of an inquiry or introduction does not guarantee a fee. All payouts are subject to Uncapco’s final underwriting, internal approval, and successful funding of the subject loan. Uncapco reserves the right to deny a fee if we believe, in our sole discretion, that the partner has violated these Terms or applicable licensing laws.

19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Uncapco Financial, LLC regarding the Website and supersede all prior and contemporaneous understandings relating to the Website.

20. Regulatory Disclosures

Uncapco Financial LLC is an Equal Housing Opportunity lender. We provide business-purpose financing without regard to race, color, religion, national origin, sex, handicap, or familial status. All loans are subject to credit approval and property qualification.
